Direct Challenge to the Firearms Act
I
understand that Prime Minister Martin has assigned you the responsibility of
reviewing the Firearms Act, and according to the CanWest News Service you have
stated that "all options remain open".
I
sincerely hope that news report is true. As I said directly to the Prime
Minister in Prince Albert on 16 January of this year, the only sane, logical
option is to repeal the entire Firearms Act - now !
The
Firearms Act is horrendously wasteful, and totally unnecessary. More
importantly, the Firearms Act violates at least seven specific Rights and
Freedoms guaranteed to all Canadian citizens under the Canadian Charter of
Rights and Freedoms, the Canadian Bill of Rights, the Canadian Constitution, the
British North America Act, English Common Law, and the English Bill of Rights.
Specifically the Firearms Act violates our rights to privacy, security of
person, presumption of innocence, association, representation, mobility, and
freedom from unreasonable search and seizure. By destroying these
basic human Rights the Firearms Act attempts to turn our right to protect
ourselves into a mere privilege. I
will never register my firearms and I will never apply for a license simply to
own my firearms.
If
you honestly believe that the Firearms Act was passed to make Canadians safer
then you must explain to the people of Canada why my associates and I are not in
prison. For over a year, on over thirty occasions we have directly challenged
this unjust law, providing irrefutable evidence of our contravention of this Act
directly to federal crown prosecutors in each province. If
this law is so essential to the security of my neighbors, why have the RCMP not
charged me for "unauthorized possession" of the over forty
unregistered shotguns and rifles which I have in my home ?
The
answer is inescapable: My associates and I are NOT a threat to Canadian society.
If we were the RCMP should have raided our homes and confiscated our firearms.
Ms.
Guarnieri, no amount of "fixing" or "reviewing" can make
this unconstitutional law just. Demonstrate some much needed leadership. Repeal
this absolutely useless, outrageously expensive law.
